This electronic platform Outing or the Outing website, referred to as the Outing site, website, platform, or "outing," is an application available for your personal or business use. Your access, registration, and use of the site are subject to these terms and conditions of use and the regulations of the State of Kuwait. Upon your access and entry to the platform, you agree unconditionally to these terms and conditions of use, and this agreement becomes effective from your registration date. The use of the platform includes a number of terms and conditions subject to continuous updates and changes as needed. Any modification or update to any of these terms and conditions becomes effective immediately upon approval by Outing management, which requires you to continuously review the terms of use and disclaimer principles to learn about any updates made to them. Your continued use of the platform means you are aware of and fully accept any modifications made to the terms of use, and Outing management is not required to announce any updates to these terms.

Legal Agreement
These terms and conditions represent "Terms" that constitute a binding legal agreement between you and Outing governing the right to use the website, applications, and other Outing offerings for users "referred to as guests or customers" to search for and book services and accommodations for use. Outing also provides "unit lessors or hosts" with a means to display accommodations and provide services, and each purpose of the host service is referred to as "Host Listings." Outing does not own, control, provide, or manage any Host Listings or hosting services.

Complementary Policies
- Outing establishes other complementary terms and policies to these terms, such as the Privacy Policy that explains how personal data is collected and used, and payment terms referred to in any section governing any payment services provided by Outing entities and payment operations for hosts.
- The Outing page helps you use our "Platform" and understand our ratings, rankings, and recommendations, how to deal with us, and more.
- Our "Content Standards and Guidelines" help us keep everything on our "Platform" appropriate and suitable for our global audience without limiting freedom of expression, and explain how we manage content and take action against inappropriate content.
- All this information is important because it (along with your booking confirmation email and any pre-contractual information provided before booking) defines the legal terms under which "Service Providers" offer their "Booking and Travel Experiences" through our "Platform."
- If something goes wrong with your "Booking Experience," this "Terms" explains what you can do about that error, including filing a complaint with us, going to court, and using online dispute resolution services (in some cases).

About These Terms
- When you complete your booking, you agree to these "Terms" and any other terms displayed during the booking process.
- If any authority determines that some of these terms are illegal, the rest of the terms will continue to apply.
- These terms are structured as follows:
- Section: General Terms, for all types of booking experiences
- Section: Specific terms for one type of booking experience
- If there is a mismatch between general terms and specific terms, the specific terms will apply.
- The Arabic version of these "Terms" is the original version. If there is any objection about the "Terms" or any mismatch between the "Terms" in Arabic and another language, the "Terms" as they appear in Arabic will be applied, unless local law requires otherwise. You can change the language at the top of this page.
- We work with companies that provide local support services (such as customer support or account management), and they do not:
- Control or manage our "Platform"
- Own their own "Platform"
- Have any legal or contractual relationship with you
- Provide "Booking Experiences"
- Represent us, or enter into contracts or accept legal documents on our behalf
- Act as "operation or service agents" for us

Our Platform
- We obtain information from service providers, and we cannot guarantee the accuracy of everything, but when providing our "Platform," we exercise reasonable care and act with professional integrity and diligence. Unless there is negligence or failure on our part to do so, we cannot be held responsible for any errors, service interruptions, or lack of information, and of course, we will do everything we can to correct or fix it as soon as we learn about it.
- We are always working to improve our customers' experience with Outing, so sometimes we show different designs, formulations, products, etc. to different people to see how they interact. As a result, some services or terms may not appear to you when you visit our "Platform."
- Our "Platform" does not represent a recommendation or endorsement of any "Service Provider" or their products, services, facilities, vehicles, etc.
- We are not a party to the terms concluded between you and the "Service Provider." The "Service Provider" is solely responsible for the booking experience.
- To make a "Booking," you may need to create an "Account." Please ensure that all your information (including payment and contact data) is correct and updated, otherwise you may find that you cannot access your booking experience(s). You are responsible for anything that happens to your "Account," so please do not allow anyone else to use it and please keep your username and password confidential.
- We will show you offers available to you in the language we (think is) appropriate for you. You can change it to another language whenever you want.
- Unless otherwise stated, you must be at least 18 years old to use the "Platform."

Our Values
- You will do the following:
- Adhere to our values
- Comply with all applicable laws
- Not use the "Platform" to cause annoyance or make fake bookings
- Use the "Platform" experience for its intended purpose, not cause any annoyance or harm, and not behave inappropriately with "Service Provider" staff (or anyone else, for that matter)

Prices
- When you make a "Booking," you agree to pay the cost of the "Booking Experience," including any fees and taxes that may apply.
- Cases of obvious errors and clear typographical errors are not binding. For example: if you book a luxury chalet that was mistakenly displayed for 1 dinar, your booking may be canceled and we will refund any amount you may have paid.

Payment
- For some products/services, the "Service Provider" will request "Advance Payment" and/or payment during your "Booking Experience."
- If we organize your payments, we (or in some cases our subsidiary) will be responsible for managing your payments and ensuring completion of your transaction with our "Service Provider." In this case, your payment constitutes final settlement of the price due and payable.
- If the Service Provider charges you, this will usually be done personally at the beginning of your "Booking Experience," but can also (for example) be deducted from your credit card at booking or paid at checkout from your "Accommodation." This depends on the "Service Provider's" "Advance Payment" policy as communicated to you during the booking process.
- If the "Service Provider" requests "Advance Payment," payment may be taken or authorized in advance when you make your "Booking," and this may be non-refundable. So before making a booking, please review the "Service Provider's" "Advance Payment" policy (available during the booking process), which we do not influence and are not responsible for. This does not affect your rights if you have any problems related to your "Booking Experience." Please refer to the "What if something goes wrong?" section.
- If your payment method is denominated in a different currency from the payment operation, your bank or payment method provider (or their affiliated payment service providers) may charge you additional fees. For example, this can happen if your credit card is in dollars but you are charged in dinars. If this will happen, we will inform you during the booking process in dinars.
- If you know or suspect any fraudulent behavior or unauthorized use of your "Payment Method," please contact your payment service provider as soon as possible.
- If the currency specified on the "Platform" is not the same as the "Service Provider's" currency, your currency is converted to dinars, which is the platform's currency.

Policies
- When you make a "Booking," you accept the applicable policies as displayed during the booking process. You will find each service provider's cancellation policy and any other policies (about age requirements, insurance deposits/damage deposits, group booking add-ons, additional beds, pets, accepted cards, etc.) on our "Platform" in the service provider information pages, during the booking process, in writing, and in the electronic confirmation message or ticket (if applicable).
- If you cancel a "Booking" or do not show up, any cancellation/no-show fees and any refunds will depend on the "Service Provider's" cancellation/no-show policy.
- Some "Bookings" cannot be canceled for free, while others can be canceled for free before a certain deadline.
- If you booked with advance payment (including all price components and/or damage insurance deposit, if possible), the "Service Provider" may cancel the "Booking" without notice if unable to collect the balance on the specified date. If the "Service Provider" cancels, any refund of non-refundable payments you made will be at their discretion only. It is your responsibility to ensure payment is completed on time (so that your bank, debit card, or credit card details are correct and sufficient funds are available in your account).
- If you believe you will not arrive on time, please contact your "Service Provider" and inform them of your expected arrival time. It is your responsibility to ensure you arrive on time, and if this does not happen, we are not responsible for any associated costs (such as canceling your booking or any fees the "Service Provider" may charge).
- As the person making the "Booking," you are responsible for the actions and behavior (regarding the "Booking Experience") of each individual in the group. You are also responsible for obtaining their permission before providing us with their information.

Intellectual Property Rights
- Unless otherwise stated, all rights in our "Platform" (technology, content, trademarks, look and feel, etc.) are owned by (Outing Company or its licensors). By using our "Platform," you agree to do so for the intended purpose only and in compliance with the stated requirements.
- You are not permitted to monitor, copy, extract/track, download, reproduce, or otherwise use anything on our "Platform" for any commercial purpose without written permission from Outing or its licensors.
- We closely monitor every visit to our "Platform" and will prevent any person (and any automated system) we suspect of doing the following:
- Conducting an unreasonable amount of searches
- Using any device or software to collect pricing or other information
- Anything that places unnecessary stress on our "Platform"
- By uploading any reviews/photos to our "Platform," you confirm that they meet our applicable Content Standards and Guidelines and that:
- They are truthful (i.e., you have not altered the image, for example, or uploaded an image of a different accommodation)
- They do not contain any viruses
- You are allowed to share them with us
- You own (or are allowed to use) any intellectual property rights
- We are allowed to use them on our "Platform" and for any other commercial purposes (including marketing and advertising), on any media, and worldwide, unless you ask us to stop using them
- They do not violate other people's privacy rights
- You accept full responsibility for any legal claims against Outing related to them
- For clarification only: We are not responsible for any images uploaded to our "Platform," and we are allowed to remove any image at our discretion (for example, if we discover that the image does not meet the standards mentioned above).

What if Something Goes Wrong?
- If you have an inquiry or complaint, please contact our customer service team. You can do this by accessing your booking, through our app, or through our Help Center where you will also find some useful frequently asked questions. You can help us assist you as quickly as possible by providing:
- Your booking confirmation number, your contact details, and your Outing PIN (if you have one), and the email address you used when making the "Booking"
- A summary of the problem, including how you would like us to help you
- Any supporting documents (bank statement, photos, receipts, etc.)
- All inquiries and complaints are recorded, and the most urgent ones are handled as top priority.

Communication with Service Provider
We may help you communicate with your "Service Provider," but this does not mean we bear any responsibility for the "Booking Experience" or for anything the "Service Provider" does or refrains from doing. We cannot guarantee that they will read any message from you or do what you ask. The fact that you communicate with them or they contact you does not, in itself, mean you have any reason to take legal action. If you need help, please contact us through our Help Center.

Measures Against Unacceptable Behavior
- If you violate these "Terms" (including our values and applicable "Content Standards and Guidelines") or fail to comply with applicable laws and regulations, we have the right to:
- Stop you from making any "Bookings"
- Cancel any "Bookings" you have already made
- Stop you from using both:
- Our "Platform"
- Our customer service
- Your "Account"
- If we cancel a "Booking" as a result, you may not be entitled to a refund (depending on circumstances). We may tell you why we canceled your "Booking," unless (a) telling you would violate applicable laws or prevent or hinder fraud detection or prevention or other illegal activities. If you believe we incorrectly canceled your "Booking," please contact our customer service team.

Liability Limits
- Nothing in these "Terms" limits our liability or the Service Provider's liability (1) when there is negligence on our part (or theirs) resulting in death or bodily injury, or (2) in case of fraud or fraudulent misrepresentation, or (3) regarding gross negligence or intentional misconduct, or (4) if this liability could not otherwise be limited or legally excluded.
- If you violate these "Terms" and/or the "Service Provider's" terms, we will not be liable for any costs you incur as a result.
- We are not responsible for:
- Any losses or damages that were not reasonably foreseeable when you made the "Booking" or agreed to these "Terms"; or
- Any event that was reasonably beyond our control
- We make no promises regarding "Service Providers'" products and services other than what we explicitly state in these Terms.
- To the extent permitted by law, the maximum we (or any "Service Provider") bear (whether for a single event or series of related events) is reasonably foreseeable losses or damages related to your "Booking(s)."
- For clarification only, these "Terms" are concluded between us and you. Nothing in these "Terms" gives any third party other than the "Service Provider" anything.
- You may be protected under mandatory consumer protection laws and regulations that guarantee you rights that no company's terms can override. If there is any conflict between those laws and regulations and these "Terms," the mandatory consumer protection laws and regulations prevail.

Applicable Law and Competent Court
These Terms shall be subject to Kuwaiti law (for accommodations, if you are a consumer living outside Kuwait, we may file a lawsuit against you in the courts of the country where you live).

Amendment Clause
- We may make changes to these Terms. If these changes are material, we will notify you before they take effect, unless applicable law requires otherwise.
- If you do not accept the changes, please do not use our Platform.
- Otherwise, your continued use of the Platform after the effective date of the proposed changes will constitute your acceptance of the revised Terms.
- Any existing bookings remain subject to the Terms that were in effect when the booking was made.

Contractual Relationship
- When you make (or request) a "Booking," it will be done directly with the Service Provider, and we are not a "contractual party" to it.
- Outing owns and operates the "Platform."
- Our "Platform" only displays "Accommodations" that have a business relationship with us (in some cases, through a partner company, please refer to "Offer from our partners") or with our affiliated "Connection providers," and does not necessarily display all their products or services.
- Information about "Service Providers" (e.g., facilities, house rules, sustainability procedures) and their "Booking Experiences" (e.g., prices, availability, cancellation policies) is based on what they provide to us.

What We Will Do
- We provide the "Platform" through which "Service Providers" can promote and rent their "Accommodations," and you can use it to search, compare, and book them. We provide a personalized experience based on how you use our "Platform" (including what you tell us) so you can book the ideal "Accommodation" with us. Our "Platform" allows you to explore "Accommodations" worldwide, and our search results make it easier to find the right place for you.
- When you book the "Accommodation" of your choice, we will confirm your "Booking" details to you and the "Service Provider," including guest name(s).
- According to your "Booking" terms, you may be able to change or cancel it if you wish. Please contact us through our Help Center (available 24 hours a day) if you need any assistance.
- If you want to object to a decision related to content moderation or report any content on our Platform, the Content Standards and Guidelines explain how to do this and how we manage these requests.
